What do these terms and conditions regulate?

1.1 This site www.nandos.co.za ("Website") is made available by Nando’s.  Nando’s is registered as Chickenland (Pty) Ltd, ("Nando's", "we", our" or "us"). Any reference to "Nando's", "we", "our" or "us" includes our employees, officers, directors, representatives, agents, shareholders, affiliates, subsidiaries, holding companies, related entities, advisers, sub-contractors, service providers, successors, assigns and suppliers.

1.2 These terms and conditions (the "Terms") apply to any person who uses, accesses, refers to, views and/or downloads the information made available by us on the Website for whatever purpose ("Content") (hereinafter referred to as "users", "you" or "your"). The display of Content and your ability to view, access, use, and/or download the Content on the Website shall be referred to as the "Services".

1.3 You agree that you are solely responsible for obtaining and maintaining all facilities, services, products and equipment which may be required by you to use the Website and the Services. You must, at all times, provide your own hardware, software as well as a modem and internet connectivity and telecommunications infrastructure.

Your agreement to these Terms

2.1 By continuing to access our Website or use our Services in any way, you agree that you enter into a legally binding contract with us upon these Terms and our privacy policy which is accessible at http://www.nandos.co.za/privacy-policy ("Privacy Policy").

2.2 These Terms, the Privacy Policy, and any additional document we incorporate by reference in these Terms, including, where applicable, (i) the terms and conditions relating to any goods and products ordered online, which are available on the Website ("Online Terms and Conditions"), and (ii) the terms and conditions relating to our loyalty programme which are also available on the Website, constitute the complete and exclusive understanding and agreement between you and us.

2.3 If you do not agree with any term or condition in these Terms, the Privacy Policy, or any policies or additional documents we incorporate by reference, or any subsequent changes thereto or become dissatisfied with us, the Website or our Privacy Policy, you must not continue to use the Website or our Services.

2.4 These Terms may be updated or amended by us at any time in our sole discretion. Each time you use the Website and/or our Services, it is your responsibility to review these Terms and the Privacy Policy in case of any such updates or amendments. If you do not agree to Nando's updates or amendments, you must not continue to use the Website or our Services.

Accessing and the use of the Services

3.1 The Website and the Services available through the Website may contain links to other Third Party Websites, including (without limitation) social media platforms ("Third Party Websites"). If you link to Third Party Websites, you may be subject to those Third Party Websites’ terms and conditions and other policies.

3.2 We do not permit copyright infringing activities and infringement of intellectual property rights on the Website, and we may, at our sole discretion, remove any infringing Content if we are of the view that such Content infringes on another's intellectual property rights or our own.

3.3 Hyperlinks provided on this Website to non-Nando's sites, are provided "as is" and Nando's does not necessarily agree with, edit or sponsor the content on such websites. No person, business or website may frame this Website or any of the pages on this Website in any way whatsoever.

Loyalty Programmes and Competitions (where applicable)

4.1 Nando’s offers loyalty programs in certain countries or territories. You can check if Nando's offers a loyalty program in South Africa by visiting our Website. If we do not offer any loyalty programmes in South Africa, clauses 4.2 and 4.3 of these Terms do not apply to you.

4.2 To the extent Nando's offers participation in certain loyalty programme/s in South Africa as listed on the Website. Should you be a member of any such loyalty programme and wish to earn loyalty rewards or discounts on Nando's products, please refer to the loyalty programme link on the Website.

4.3 If you are already a member of a Nando's loyalty programme, you can check your balance by following the loyalty programme link on the Website.

4.4 Certain parts of the Website may contain competitions or promotions from Nando’s or third parties. The terms and conditions for those competitions and promotions will be specified on the relevant part of the Website from time to time. By entering or participating in the relevant competition or promotion you agree to be bound by the relevant terms and conditions. Notwithstanding any specific terms and conditions, Nando’s specifically retains the right, at any time and without notice, to remove, alter or add to competitions or promotions on the Website without any liability to you.

Accuracy of Information

5.1 Whilst all reasonable and foreseeable steps and precautions have been taken to ensure the accuracy of all of the Content available on the Website, the Content is intended and produced for general information purposes only, and to the extent allowed by law, should not be relied upon by you as specific advice of any kind.

5.2 You understand and agree that the information, details and descriptions set out on this Website, including the details regarding the prices, menus, products, services, and available careers, may change from time to time. This Website may therefore not always contain the correct or most up-to-date information, details and descriptions relating to our Services. 5.3 You acknowledge that any nutritional advice on the Website is not intended to, and does not, constitute professional advice or a replacement or substitute for professional advice of any nature whatsoever.

Your behaviour when using the Website and the Services

6.1 You may not use the Website to obtain or distribute:

6.1.1 copyrighted material or material protected by law; or

6.1.2 material containing viruses or any other destructive materials or data or code which is able to corrupt, interfere with, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation of a computer system or hardware or software.

6.2 You must not perform any act which may jeopardise or interfere with the functionality or the operation of any part of the Website or our Services.

6.3 You are strictly prohibited from using the Website for "spoofing", "hacking", "flaming", "cracking", "phishing" or "spamming" or any other activity designed or aimed at achieving purposes similar or the same as the aforementioned acts.

On notice by Nando's, you agree to stop any activity which Nando's does not consider, in its sole and absolute discretion, to constitute fair use.

6.7 You are permitted to create a hyperlink to the Website so long as the link does not portray us, our employees, affiliates or agents in a false, confusing, misleading, derogatory, or otherwise offensive manner or in any way associate us with any derogatory or otherwise offensive content. You also agree to ensure that any hyperlink to the Website is clearly visible.

6.8 Any restrictions on the use of the Website or the Content shall also apply to any part of the Website or the Content which may be cached when using the Website or the Content.

6.9 In addition, you shall not  allow a third party to:

7.2 You agree to not engage in the use, copying, or distribution of any of the Content other than as expressly permitted herein, including any use, copying, or distribution of Content of third parties obtained through the Website for any commercial purposes. 7.3 You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any Content or enforce limitations on the use of the Website or the Content therein. All moral rights of Nando's are reserved.

7.4 Any reproduction, modification, creation of derivative works from or redistribution of the Website, the Content, or the collective work or compilation is expressly prohibited. Copying or reproducing the Website, the Content, or any portion thereof to any other server or location for further reproduction or redistribution is expressly prohibited.

7.5 You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in the Services. Without limiting the foregoing, you agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any aspect of the Services.

Collection of Personal Information

8.1 We collect personal information from you. We will handle the collection, processing and storage of your personal information in accordance with our privacy policy further described in our Privacy Policy accessible at http://www.nandos.co.za/privacy-policy.

8.2 By disclosing or submitting your personal information to us, you consent to us collecting, processing and storing your personal information for the purposes described in our Privacy Policy.

Indemnity

9.1 As far as the law allows, you agree to defend, indemnify us and hold us and our officers, subsidiaries, holding companies, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising from:

9.1.1 your use of and access to the Website and/or the Services;

9.1.2 your violation of any term of these Terms;

9.1.3 your violation of any third party right, including without limitation any copyright, trademark, trade secret or other property, or privacy right; or

9.1.4 any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive termination, modification or expiration of these Terms and your use of the Services and the Website.

Limitation of Liability

10.1 Subject to clause 11.2 below, we shall not be liable for any damage, loss or liability of whatsoever nature arising from your use of or inability to use the Website or the Services or Content provided from and through the Website. Furthermore, we make no representations or warranties, implied or otherwise, that, amongst others, the Content and technology available from the Website are free from errors or omissions or that the Services will be 100% uninterrupted and error free.

10.2 No provision of these Terms (or any contract governed by these Terms):

10.2.1 does or purports to limit or exempt us from any liability (including, without limitation, for any loss directly or indirectly attributable to our gross negligence or wilful default or that of any other person acting for or controlled by us) to the extent that the law does not allow such a limitation or exemption; and

10.2.2 requires you to assume risk or liability, to the extent that the law does not allow such an assumption of risk or liability.

Exclusion of Warranties and Representations

11.1 While the goods and Services sold via the Website may be subject to the additional payment terms and conditions accessible via the Website, to the extent allowed by law, the Website and the Content are supplied on an "as is" basis and have not been compiled or supplied to meet your individual requirements. It is your responsibility to satisfy yourself prior to entering into this agreement with us that the Services available from and through the Website will meet your individual requirements and be compatible with your hardware and/or software.

11.2 As far as the law allows, the Website and the Services are provided without any representation or warranty whatsoever, whether express, implied or statutory, including (without limitation) any representation or warranty as to the operation, integrity, compatibility, availability or functionality of the Website or as to the operation, accuracy, completeness, integrity, compatibility, availability functionality or reliability of the Content.

Assignment

12.1 These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction. Any assignment or transfer by you shall be null and void.

Successors and Assigns

13.1 These Terms shall inure to the benefit of and be binding upon each party's successors and assigns.

Violation of Terms

14.1 Please report any violations of the Terms (including the Privacy Policy or any documents incorporated by reference) that you become aware of by contacting us at http://www.nandos.co.za/contact. Any failure to act by us with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches by you or others.

Electronic Communications

15.1 By using the Website and/or the Services, you agree that all agreements, notices, disclosures and other communications sent by you or Nando's satisfy any legal requirements, including but not limited to the requirement that such communications should be "in writing". For the purposes of this clause, a "data message" means data generated, sent, received or stored by electronic means.

15.2 You agree specifically that:

15.2.1 the agreement will be treated as if it was concluded at our physical address on the date on which you first made any use of the Website and/or Services;

15.2.2 an electronic signature is not required by you or us for purposes of agreeing to these Terms;

15.2.3 your use of the Website and/or the Services is sufficient evidence of your agreement to these Terms;

15.2.4 any data message sent by either you or us to the other will be deemed to have been sent from our physical address if neither your usual place of business nor residence is located within South Africa;

15.2.5 subject to the further provisions of these Terms, any communication sent to you by an information system programmed to operate automatically on our behalf will be a data message attributable to, or authorised by us; and

15.2.6 subject to the further provision of these Terms, a data message sent by you to us will only be treated as having been received by us when an acknowledgement of receipt is sent by us personally or a person who has authority to act on our behalf in respect of that data message.

Interpretation and Miscellaneous Provisions

16.1 These Terms and the relationship between us shall be governed and construed in accordance with South African law. Any disputes arising in connection with these Terms and our Services shall be subject to the exclusive jurisdiction of the South Gauteng High Court, South Africa. Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid (including, without limitation, because such provision is inconsistent with the laws of another jurisdiction) or inapplicable, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision.

16.2 The termination of any contract created by these Terms will be without prejudice to any other rights or remedies that you or we may be entitled to under the agreement or at law, and will not affect any of our or your accrued rights or liabilities nor the coming into or continuance in force of any provision of these Terms which is expressly or by implication intended to come into or continue in force on or after such termination.

16.3 If these Terms (or any contract governed by these Terms) or the Services provided and/or made available on the Website are regulated by or subject to the Consumer Protection Act 68 of 2008, as may be amended from time to time (the "Consumer Protection Act"), it is not intended that any provision of these Terms contravene any provision of the Consumer Protection Act.  Therefore all provisions of these Terms must be treated as being qualified, to the extent necessary, to ensure that the provisions of the Consumer Protection Act are complied with.

Receive a Voucher – Terms & Conditions of Participation Nando’s Mitchell’s Plain

1. This promotion is organised by Chickenland (Pty) Ltd (the “Promoter”).

2. The promotion is open to permanent residents and citizens of South Africa over the age of 18 years.

3. By participating in the promotion, all participants and the recipients of Vouchers (“Recipients”) agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will, subject to any consumer rights under the Consumer Protection Act, be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this promotion and any prize (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deem necessary.

4. The promotion applies only to Nando’s Mitchell’s Plain and will commence on the 1st day of August 2017 and ends on the 1st day of October 2017 both days inclusive.

5. There are 500 Nando’s vouchers (“the Vouchers”). The Vouchers are each valued at 1 x 500ml Coke.

6. To receive one of the Vouchers, participants must either:

Visit Nando’s Mitchell’s Plain in South Africa;

  • order a half chicken and a side @ R84.90 meal; • follow the instructions set out on the point of sale or website;
  • SMS your “name”, “Nando’s Mitchell’s plain to 32140 (at a cost of R1.00 per SMS);
  • you will then receive an SMS stating: “Thanks for participating, you have received a wicode voucher to redeem a FREE 500ml Coke;
  • valid at Nando’s Mitchell’s Plain only until 1st of October 2017.”
  • retain your till slip as proof of purchase.

7. The Recipients will be notified by SMS as set out above on the same date on which the participant sent the SMS to 32140.

8. Participants may partake in the promotion as many times as they wish provided that every entry will be in respect of a new purchase at Nando’s Mitchell’s Plain.

9. Entries which are unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or from Disqualified Persons, will be declared invalid.

10. The Promoter is not liable for any defect in the Vouchers. The Promoter reserves the right to substitute the Vouchers with any other prize of comparable commercial value. All ancillary costs, including but not limited to transport, meals, personal and incidental expenses or other fees applicable are the responsibility of the Recipient and/or participants.

11. Should any dispute arise in relation to the interpretation of these promotion rules, the Promoter’s decision shall be final and no correspondence shall be entered into.

12. All participants and the Recipients, as the case may be, indemnify the Promoter, its advertising agencies, advisers, nominated agents, suppliers and franchisees, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotion (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Vouchers).

13. The Promoter may require the Recipients to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any Recipient refuse or be unable to comply with this rule for any reason, such Recipient will be deemed to have rejected the Voucher and it shall revert back to the Promoter.

14. All participants and Recipients agree to make available to the Promoter their personal information (which is necessary for the purposes of this Promotion) and agree that the Promotor may process such personal information in this regard.

15. The Promoter may require the Recipient and/or his/her partner be identified, photographed and the photographs published in printed media, or to appear on radio and television, when accepting his/her Voucher and/or after having received his/her Voucher. The Recipient and/or his/her partner will be given the opportunity to decline to the publication of their images and to participate in the Promoter’s marketing material in so far as it relates to the promotion.

Win Nando’s for One Year – Competition Rules Nando’s Bryanston

1. This competition is organised by Chickenland (Pty) Ltd (the “Promoter”).

2. The competition is open to permanent residents and citizens of South Africa over the age of 18 years except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their advertising agencies, advisers, dealers, suppliers and franchisees, its affiliates and/or associated companies (“Disqualified Persons”).

3. By entering the competition, all participants and the winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will, subject to any consumer rights under the Consumer Protection Act, be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prize (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deem necessary.

4. The competition commences on the 1st day of July 2017 and ends on the 31st day of August 2017 both days inclusive.

5. There is one Nando’s gift card (“the Prize”). The Prize is valued at R3 600.00.

6. To stand a chance of winning the Prize, participants must either:

7. An electronically generated random draw will take place on the 11 day of September 2017. The winner of the Prize will be notified by Nando’s telephonically on the 12 day of September 2017. If however the winner cannot be reached after 4 (four) attempts have been made during normal business hours within a period of 24 (twenty-four) hours for any reason whatsoever, the Prize will be forfeited and another winner will be selected in accordance with the Rules and at the sole and absolute discretion of Nando’s..

8. The winner will be announced on the 18 day of September 2017.

9. If required by the Minister for Trade and Industry, the Lotteries Board or for any other reason whatsoever, Nando’s will be entitled to terminate the lucky draws immediately without notice to entrants. In such an event all entrants and/or the winners hereby waive any rights which they may have against Nando’s.

7. The Recipients will be notified by SMS as set out above on the same date on which the participant sent the SMS to enter to win Nandos for a year.

To stand a chance of winning the Prizes, participants must: (i) visit a Nando’s Restaurant in South Africa; (ii) order any Nando’s menu item; (iii) purchase 330ml/500ml/2litre Coca-Cola soft drink; (iv) follow the instructions set out on the till talker/placemat which will be displayed on the counter near the till and on tables; and:

7. Electronically generated random draws will take place on 25 September 2017 to 25 October 2017. The winners of the Prizes will be notified by Nando’s telephonically by 30 October 2017. If however the winner/s cannot be reached after 4 (four) attempts have been made during normal business hours within a period of 24 (twenty-four) hours for any reason whatsoever, the Prize will be forfeited and another winner will be selected in accordance with the Rules at the sole and absolute discretion of Nando’s. These competition rules (“the Rules”) apply to your entry into and participation in the Nando’s For Flavour’s Sake Competition (“the Competition”). By participating in the Competition and/or accepting any prize, you agree that you have read, understood and agreed to be bound by these Rules.

The Competition is promoted by The Grocery Company SA (“Nando’s). Reference to “Nando’s/we/us” is a reference to Nando’s South Africa (including all of its Nando’s franchisees). Reference to “you/your” is a reference to any participant in the Competition.

1. Eligibility

1.1. In order to be eligible for entry into the Competition, you must:

1.1.1. be a natural person of 16 years of age or older;

1.1.2. be a permanent resident of South Africa;

1.1.3. possess a valid ID document / passport / driver’s license; and

1.1.4. have established a personal profile at www.facebook.com (“your Facebook profile”). Individuals operating a Facebook Page shall not be eligible for entry into the Competition via such Page.

1.2. The following persons are not eligible for entry into the Competition:

2. How to enter

2.1. You can enter the Competition by visiting www.facebook.com/NandosSouthAfrica watching our “For Flavour’s Sake” videos and by telling us why you need a Nando’s sauce to help turn your meal from good to great. We encourage you to share your entry into the Competition with your Facebook friends, although doing so does not improve your chances of winning.

2.2. Entries open at 00:01 on 1 August 2017 and close at 23:59 on 31 October 2017. Entries submitted after this date will not be accepted.

2.3. Entries not completed in accordance with these Rules or not in compliance with the eligibility criteria of the Competition will be invalid.

2.4. As part of the entry process, you will be requested to authenticate your entry using your Facebook profile. By doing so, you expressly authorise us to access data necessary to administer your entry into the Competition from Facebook.

2.5. Every effort is made to keep the Nando’s Facebook and website up and running smoothly, however Nando’s is not liable for any technical failures or temporary unavailability that may affect participation in the Competition.

2.6. There are no charges or fees payable for participation in the Competition. Please note, however, that access to www.facebook.com and the Nando’s website may incur data charges. Your use of these websites is at your own cost.

2.7. By entering the Competition:

2.7.1. you agree that your name and/or image may be shown as an entrant on the Nando’s Facebook page (www.facebook.com/NandosSouthAfrica) and

2.7.2. you agree that, if you are selected as a winner, Nando’s may use your name and/or image in Nando’s marketing material, on the Nando’s Website and/or on selected Nando’s social media channels, and may require you to participate in certain marketing activities relating to the Competition. You may withdraw this consent, or refuse to participate in such marketing activities, at any time.

3. Winners

3.1. There will be 100 winners, chosen by Nando’s, from the Facebook posts (by visiting www.facebook.com/NandosSouthAfrica watching our “For Flavour’s Sake” videos and telling us why you need a Nando’s sauce to help turn your meal from good to great. We encourage you to share your entry into the Competition with your Facebook friends, although doing so does not improve your chances of winning).

3.2. The winners of the Competition in will be announced during the course of August to October 2017 on the Nando’s Facebook page / Website, as well as on selected Nando’s social media channels.

3.3. Nando’s retains the right to delay the timing of the publication of the winners. If the date on which the winners are to be announced is postponed for any reason, the new date will be published on the Nando’s For Friends website.

3.4. A representative of Nando’s will notify winners via Facebook, telephonically and/or via e-mail.

3.5. In the event that:

3.5.1. Nando’s is unable to contact a winner within 72 hours of the announcement, and after reasonable efforts to do so; or

3.5.2. a selected winner fails to comply with the eligibility criteria, or fails Nando’s required validation procedures (which procedures include identifying him or herself as the person that entered the Competition by providing proof of identity to the satisfaction of Nando’s, as well as providing proof of age and residency); that person’s right to the Prize will be deemed to have been waived and the Prize will be forfeited. Subject to the same conditions, Nando’s will award the Prize to the next eligible participant.

3.6. Nando’s may refuse to award the Prize to a selected winner if these Rules have not been adhered to or if any irregularities or fraudulent practices are detected.

4. Prize

4.1. General

4.1.1. There will be 100 gift packs up for grabs. Each winner (selected at the discretion of Nando’s) will receive one 6 pack of 250g PERi PERi sauces. Each gift pack will contain 1 x Lemon & Herb, 1 x Mild, 1 x Medium, 1 x Hot, 1 x Extra Hot and 1 x XX Hot 250g PERi PERi sauce.

4.1.2. The Prize is not transferable or redeemable for cash and/or meal vouchers.

4.2 Delivery

4.2.1 Prizes will be couriered to each winner. Each winner will be required to provide a physical address within South Africa (either work or residential address) where the prize can be delivered within working hours. No prizes will be delivered to a P.O. Box address.

5. Personal Information

5.1. By participating in the Competition, you acknowledge and agree that Nando’s may collect and use your personal information in order to process your entry into the Competition, to communicate with you, as contemplated in these Rules, as well for statistical and record-keeping purposes. This personal information may be collected directly from Facebook, and includes but is not limited to your full name, email address, cellphone number, and image. Nando’s will use only the minimum information necessary to fulfil these purposes and will retain the information only for as long as is necessary.

5.2. Personal information processed by Nando’s in terms of this clause 5 may be stored on an international database. By entering the Competition, you authorise Nando’s to store your personal information as such.

5.3. Nando’s respects your privacy and undertakes not to share, sell, rent or lease your personal information with or to third parties. Nando’s may disclose information if required to do so by law or if it is required to protect the safety, rights or property of Nando’s, its customers or the public.

5.4. Although Nando’s cannot guarantee the security of your information in the course of its transmission, it will take all appropriate, reasonable technical and organisational measures to ensure the security, integrity and confidentiality of personal information collected and stored by it in terms of this clause 5.

6. Limitation of liability

6.1. You participate in this Competition, and accept and participate in any Prize, out of your own free will and at your own risk. In no event will we be liable for any loss or damage of whatsoever nature, including without limitation any indirect or consequential loss or damage, arising out of or in connection with your participation in this Competition. To the fullest extent allowed by law, you hereby indemnify Nando’s, its holding companies, subsidiaries of its holding companies, licensors, associated companies, affiliates, subsidiaries, directors, employees and agents (the “Indemnified Parties”) against any loss, claim or damage, costs and expenses (including legal costs on an attorney and own client scale) which may be suffered by you or any third party arising in any way from your participation in the Competition, including without limitation any such loss, claim or damages that arise directly or indirectly from:

6.1.1. any breach of the Rules;

6.1.2. your acceptance of the Prize; and/or Including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Indemnified Parties.

6.2. The Indemnified Parties will not be liable for any entry that has been omitted from participation in the Competition for any reason whatsoever.

7. No Association with Facebook

The Competition is in no way sponsored, endorsed, administered or promoted by, or associated with, Facebook. By entering the Competition, you release Facebook from any and all liability that may be incurred by you as a result of or in relation to the Competition.

8. General

8.1. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid either your or Nando’s’ rights or obligations in terms of any applicable law.

8.2. In the event of a dispute in regard to any aspect of the Competition (including the prize draw and selection of winners) and/or the interpretation of these Rules, Nando’s decision will be final and binding and no correspondence will be entered into. You cannot appeal any decision as to a winner of the Competition.

8.3. Nando’s may in its sole discretion amend these Rules at any time. Such amendment shall be deemed to have taken effect from the date of publication of the revised Rules on the Nando’s website.

8.4. Nando’s reserves the right to cancel, suspend or terminate, or alter any aspect of, this Competition at any time. Nando’s shall not be liable to you or any third party as a result, and you waive any rights that you may have against Nando’s as a result of any such cancellation, suspension, termination or alteration.

8.5. No relaxation or indulgence granted by Nando’s, or failure to enforce any of its rights, shall amount to a waiver or abandonment of such rights under and in terms of these Rules, nor preclude Nando’s from exercising its rights in the future.

8.6. Should any provision of these Rules be held to be illegal, invalid or unenforceable for any reason, such provision shall be severed from the Rules without affecting, impairing or invalidating the remaining provisions, which shall to the fullest extent possible continue to be of full force and effect.

8.7. The Competition and these Rules are governed by the law of South Africa.
